N6932-1-M: Non-Profit Association Needs Help Updating its ByLaws and Guidelines

Non Profit is one of the largest music teachers associations in Georgia, operating for close to 30 years. Non Profit has noted some vagueness in its By-Laws and Guidelines, particularly in the area of scholarship. Client would appreciate a review and recommendations  for changes, updates and whether guidelines should be incorporated into the By-Laws. Following review and advice, Client would appreciate the volunteer revising its By-Laws and Guidelines, as needed.

A6101-2-D: Copyright Dispute

Artist has, for 25 years, created content, artwork, programs and curriculum. She created a youth entrepreneurship program at her place of employment (AP). Artist was hired to manage, not create the program, but found, when she arrived there was no curriculum. Artist confirmed with her supervisor as well as leadership at AP that she owned the program she created. After Artist left her position, AP requested Artist sign a separation agreement stating that AP owned the program and all related materials, which Artist refused. AP has since been the name of the Program Artist created, but with different, lower quality curriculum. Artist feels this is both misleading and affects her reputation, As well, AP has been using some of the intake content and artwork Artist created. Artist would like advice as to whether she owns the Program, artwork and name of the Program and to enforce those rights.

N6920-1-R: Non-Profit Needs Advice on  Allegation of Trade Name/Mark Infringement

Client is a non-profit that promotes choral music (composition and choral performance) of historically under-represented musical voices. Client recently received a letter from another choral group claiming name infringement/confusion with a registered trade name. Client would appreciate advice and assistance in responding to the letter and resolving the potential issue.

 

A5454-1-R: Digital Marketer and Content Creator Needs Assistance with Trademark Registrations

 

Client is a digital marketer and content creator who would like to register a service mark on a use basis and a trademark for goods on an intent to use basis.  She's been using the word mark since at least as early as 2020 in respect to services and intends to start to use it in respect of goods in 2025. She holds the url for the words she would like to register.
